Cannabis/Marijuana/Weed

Possession:

• Without a prescription, possession of cannabis is criminal in the State of Florida.
•  Misdemeanor: Possession of less than 20 grams. 
• Penalties: Up to one year in jail, one year of probation, and a $1,000 fine.
• Felony: Possession of 20 grams or more.
• Penalties: Up to five years in prison, five years of probation, and a $5,000 fine.  

• Sale/Distribution: 
• Sale or distribution is when an individual sells, manufactures, or delivers cannabis; or possesses cannabis with intent to sell, manufacture, or deliver.  
• First Degree Misdemeanor: Without consideration.
• Penalties: Up to one year in jail, one year of probation, and a $1,000 fine.
• Third Degree Felony: With consideration. 
• Penalties: UP to five years in jail, five years probation, and a $5,000 fine.

• Trafficking:
•  Committed when a person knowingly possesses, sells, purchases, manufactures, delivers, or transports 25 pounds or more of cannabis or 300 or more cannabis plants.
• First Degree Felony:
• Penalties: MM - 3 years prison/$25,000 fine; Up to 30 years prison
•  25 to 1,999 pounds of cannabis; or 300 to 1,999 cannabis plants
• Penalties: MM - 7 years prison/$50,000 fine; Up to 30 years prison
•  2,000 to 9,999 pounds of cannabis; or 2,000 to 9,999 cannabis plants
• Penalties: MM - 15 years prison/$200,000 fine; Up to 30 years prison
•   10,000 pounds or more of cannabis; or 10,000 or more cannabis plants.
