Cyberstalking can be defined two ways:
- Engaging to communicate either directly or indirectly using words, images, or language through electronic mail or electronic communication, directly at or pertaining to a specific person; or,
- Accessing or attempting to access a person's online accounts or internet-connected home electronic systems without that person’s permission, causing substantial emotional stress and serving no legitimate purpose. Fla. Stat. §784.048.
Who can petition for an Injunction of Protection (restraining order)?
- The affected person (victim); or
- The parent or legal guardian of an affected child.
