Burglary

In general, Florida Statute 810.02 defines Burglary as unlawfully entering a dwelling, structure, or a conveyance with the intent to commit an offense; remaining in a dwelling, structure, or conveyance surreptitiously; or remaining in a dwelling, structure or conveyance once the invitation to stay has been withdrawn, and with the intent to commit an offense. 


There are three primary categories of Burglary:


  Penalties: Penalties for Burglary depend on the primary and subcategory of Burglary that is committed. 


  •   Burglary of a Dwelling
  •   Burglary of a Structure

                         -Unoccupied

                         -Occupied

  •   Burglary of a Conveyance 

                         -Unoccupied

                         -Occupied
