Aggravated Assault

Florida Statute 784.011 defines assault as “an intentional, unlawful threat by word or act to do violence to the person of another, coupled with an apparent ability to do so, and doing some act which creates a well-founded fear in such other person that such violence is imminent.” 

  • Penalties: Assault is a Second Degree Misdemeanor, punishable up to sixty days in jail, six months of probation, and a $500 fine.

Under Florida Statute 784.021, Aggravated Assault is an Assault committed with a deadly weapon without the intent to kill, or an Assault committed with the intent to commit a felony.  



  • Penalties: Aggravated Assault is a Third Degree Felony, punishable up to five years in prison, five years of probation, and a $5,000 fine.
